UPON BOOKING WITH ME, YOU (CLIENT) AGREE TO MY TERMS & CONDITIONS AS FOLLOWED.

 

C O P Y R I G H T
The copyrights of images and photographic work will always belong to the photographer.

D I S P L A Y O F I M A G E S
The client(s) hereby allows the photographer (Jay) to display any photograph covered by this contract and terms and conditions to use for promoting the business, advertising , websites and other media platforms to help advertise the business.
If you do not feel comfortable with certain images being displayed, please let me know.

I M A G E S
Please be advised that I generate 80-100 images per hour. Maybe even more depending on the event/situation.
I take as much photos as I can for ANY service/photoshoot. But they won't all be sent to the client. Reason being as some will be duplicates.
I offer quality over quantity. I will not send any duplicates or photos that I think aren't worthy of being sent for reasons such as; they’re blurry or there's an obstructed view in the image.

L I C E N S E S, C O V E R A G E & R E P R O D U C T I O N
Any photographs taken during the course of the event will be at the discretion of myself (the photographer). No instant look of images directly from the camera will be allowed. Every ounce of effort will be made to comply with the client’s requirements.
Special requests are NOT binding requirements. Although I will make every effort to comply with the client’s wishes, I cannot guarantee specific outcomes for certain photos nor incorporate any specific background, location or group arrangements due to changes in weather and/or the availability and willingness of subjects and people.
For any bookings involving a Church or Private Venue, the photographer’s movements may possibly be restricted. The limited area from which the photographer has access to, may not be the photographer’s choice and the photographer cannot accept responsibility for any obstructed views in any photographs.
Due to a variety of lighting, Weather changing and the limited use of flash, some colours may differ throughout a set of photographs.
Even though all equipment is checked regularly and checked before every booking, the photographer will not be responsible for any photographs that are not produced due to technical failure.

P A Y M E N T
A 50% non-refundable booking fee is required upon booking to confirm your booking date and time. Depositing this fee is also your acceptance of my terms and conditions. The booking fee will the deducted from the client’s final balance.
Payment in full of the remaining balance is due no later than 48 hours prior to your booking date.
If you're making a booking within 48 hours or less prior to the date you're wanting, the full payment of your service is to be made upon booking.
If the full balance is not paid before 48 hours of your booking date or upon booking (48hr and less) this WILL result to rescheduling your booking or cancellation.

T R A V E L
Travel fee is .76c per km from my home (Henderson), as recommended by the Kilometre rates for the year 2020 - IRD.

D I G I T A L F I L E S
All computer/digital files remain the property of the photographer.
Should all digital files be lost, damaged or destroyed for the reasons beyond control, the photographer’s liability shall be limited to a full refund of any deposits and fees paid, but shall not include a refund for any goods already received.
You will receive all digital files via an online gallery protected with a password. This will be your personal gallery where you can download the images from. This reduces the risk of your images changing quality.
I DO NOT send any images via Facebook messenger or any other social platform as this WILL decrease the image quality.
Digital files can be put on a USB stick if client(s) requires for an additional fee of $5.
I DO NOT send RAW/unedited images.

O N T H E D A Y
I, the photographer, will be the sole professional (still) photographer at the venues specified. However I do encourage family, friends and guests of the client(s) to take photos throughout the day/night.

 

* WEDDING BREAKFAST, MEAL TIME and PRAYER*I, the photographer, will not take photos during these specific times mentioned just above and alike times. Instead I will use these times to take a break and respect any religious prayer.

The photographer will stay for the agreed amount of time.
The change in weather is out of my control. If the weather turns for worse on the chosen date of your booking and we have to cancel, any payment/deposits you’ve made into my account will then become credit for you to use in the future or to reschedule for another date.

L A T E N E S S
If you’re late upon arrival, I allow up to 15 minutes for you to show. If you don't arrive within 15 minutes, I will leave and no refund will be given.
I won't take any phone calls or messages saying you’re on your way, but you’ll be later than the 15 minutes given. Going over sessions by 15 minutes puts my day out and restricts my time for other clients.
Please take traffic into account when travelling.

A C C I D E N T S
Any directions issued to clients, family/friends/guests of clients or others from the photographer are ensured to be safe. No risky directions or poses will be given from the photographer.
The photographer cannot and will not be held responsible for any personal accidents during a photographic shoot.

C A N C E L L A T I O N S
Cancellations are subject to no refunds. Any deposits made into my account are non refundable.
I will refund fully if I have to cancel due to situations beyond my control (sickness: Myself or my kids or Tangihana).

D E L I V E R Y
The photographer aims to deliver your digital files as quickly as possible. However this could take up to 3-5 weeks during busy times and holiday/celebration periods. I DO NOT work on holiday/celebration periods.

***If these terms and conditions are not met by standard by the client(s), this will result in you being blacklisted for future bookings.***
